Decision:

Extension of contract for Avison Young providing multi-disciplinary commercial property/development advice relating to Golden Valley Development project.

Reasons for the decision:

            Avison Young were appointed as overall procurement adviser originally under a Homes England framework using a competitive tender process at the end of 2019. They have successfully supported the council through the procurement process as well as a number of other related activities. 

 

Avison Young were appointed using the Homes England Framework for an initial period and maximum contract value of £136,540. This was reviewed and a member decision made in early 2022 for a further £125,610 but using the Crown Commercial Services pre-tendered contract which allows direct awards.  This covered a wide range of services offering CBC greater flexibility. This has enabled professional support through the procurement and appointment process for the GVD development partner, along with a number of valuation, property and commercial services.

 

The GVD project board has now agreed that CBC will continue to use Avison Young to continue the use of the Crown Commercial Services framework which will enable continuity of commercial property advice during a critical phase of the GVD project, providing a range of multi-disciplinary commercial advice. This would be for a period up until the end of March 2024 and for a value upto £150,000. The GVD has an appropriate budget allocated for this purpose/workstream.  Sign off would be required through the project’s governance and accounting processes.

 

Avison Young play an important advisory role and their involvement is seen as being important as we go into a highly commercial stage of the project and begin to bring forward planning applications as the development agreement between CBC and HBDXF progresses.

 

 

As this is a pre-tendered framework enabling direct awards and the value is over £100K within an agreed budget – it requires a Cabinet Member decision. 

 

It is therefore agreed to proceed with the appointment of Avison Young via the CCS framework as set out above upto a value of £150,000 valid until 31 March 2024.

 

Alternative options considered:

To seek an alternative advisor at this stage would incur significant additional costs, potentially delay in progress on the procurement of a development partner and consequently delay at the start of construction on site. NB: We are able to stop using them without any contractual / financial penalties at any time during the extended period. One Legal has supported us in preparing the tender documentation and decision making.
