Purpose:

To enter in to a BID Levy Operating Agreement and a Memorandum of Understanding with Cheltenham BID Ltd.

Reasons for the decision:

Cabinet gave support to the principle of a Business Improvement District in Cheltenham on 12 January 2016 and delegated authority to to the Managing Director Place and Economic Development in consultation with the Cabinet Member Development and Safety to make decisions in respect of the Council’s obligations under the BID legislative process. As the Managing Director Place and Economic Development is a member of the BID Board authority to make the decision is with The Head of Paid to avoid any conflict of interest.

 

Following the successful ballot in April 2016 a Business Improvement District (BID) has been established and a BID company set up to deliver the projects and services outlined in a business plan which businesses voted for. An annual BID levy will be charged to business rate payers within the defined BID area to fund the projects and services. The Council as billing authority is responsible for administering and collecting the BID Levy.

 

The Memorandum of Understanding and BID Levy Operating Agreement are agreements which must exist between the council and the BID Company.

 

The Memorandum of Understanding sets out the level of service which the Council intends to provide across a range of areas of activity affecting the BID The Memorandum provides for the Council, from time, to alter or cease the provision of services.

 

The BID Levy Operating Agreement confirms the arrangements for administering and collecting the BID Levy and paying monies to the BID company.

Alternative options considered:

None – the Council as the billing authority for non-Domestic Rating (Business Rates) is legally required to administer the BID Levy
