Decision:

To enter into an agreement jointly with the Cheltenham Trust and the Cheltenham Art Gallery and Museum Development Trust for the commission of the sculpture of a bronze penguin for display at the Wilson.

Reasons for the decision:

The Cheltenham Art Gallery & Museum Development Trust is using monies bequeathed to it to commission the sculpture of a 1 metre bronze penguin to be displayed at the Wilson. The cost of the piece is £32 800 plus additional cost for the creation of a bronze piece.

 

As part of the management agreement with the Cheltenham Trust, it was agreed that the Council would retain ownership of the collections at the Wilson. Therefore the Council should enter into this commissioning agreement so that the Artist can grant the council as well as the Cheltenham Trust rights to use the penguin’s image etc should it wish to do so, without requiring approval from the Artist.

Alternative options considered:

Not entering into the agreement. This has been rejected as the artist would still need to give the Council intellectual property rights by entering into an agreement
