Decision:

To continue with the existing shared Building Control service operated by Cheltenham Borough Council for Cheltenham Borough Council and Tewkesbury Borough Council under the existing Local Government Act 1972 section 101 Agreement.

Reasons for the decision:

·       The shared service has been operational for five years. In this time the shared service has exceeded the targets set out in the original business case.

·       Both Cheltenham Borough and Tewkesbury Borough Councils have client officer and elected member representation on the governance body for the service (Joint Monitoring and Liaison Group JMLG). JMLG has confirmed that it is satisfied with the performance of the group.

·       The maintenance of the shared service for a further five years gives the Building Control service further opportunity to develop and improve service provision.

 

Alternative options considered:

·       Dissolve shared service. Not practical or beneficial for either district.

·       Expand shared service to include other local districts (Gloucester City). An excellent opportunity for the service to develop further, but so far declined by the management team at Gloucester City Council.

·       Agree a break clause in the event of either party wishing to pursue an alternative delivery option. Not in the spirit of the shared service – any revised delivery arrangement would be negotiated at the time such that neither CBC nor TBC is disadvantaged by the arrangement.

One Legal has confirmed that both Cheltenham and Tewkesbury can make an officer decision on this matter.

Cheltenham will be using the delegated authority of the Director Environmental and Regulatory Services and Tewkesbury will be using the Deputy Chief Executive for sign-off
