Decision:

To appoint Avison Young (AY) as the agents to conduct the disposal process alongside the Council of the Municipal Offices, Promenade, Cheltenham. This will occur in three stages: review of documents and familiarising themselves with the building, formulating a strategy and securing Council support to then take the opportunity to market.

Reasons for the decision:

Cabinet and full Council has agreed to dispose of the Municipal Offices and agents will be required alongside officers and decision makers to bring that opportunity forward. A procurement exercise has taken place undertaking a further competitive procedure under the CCS (Crown Commercial) Framework and following receipt of a number of bids, Avison Young (AY) was selected as submitting the comprehensive and most competitive tender submission. This decision notice provides the relevant authority to enter in the relevant contract with the chosen firm. Please see the attached tender acceptance report.

Alternative options considered:

To not appoint AY and conduct a further procurement process using another framework or an open tender process. Due to the high level of interest of agent representation every step has been diligently considered to help ensure the optimum outcomes. The tenders submitted via the CCS Framework were outstanding and from some of the top agents in the County. The Council are confident in their process for selection.

This process has commenced following a Cabinet and Council decision taken in July 2023. Procurement and Legal Services were consulted in regards to the route to market (selecting the agent). An officer decision was made following further consultation with Project Board to select a Framework option and to select CCS as the most appropriate Framework. A webpage was created to communicate more broadly as to the process to select our agent, internal teams were informed and also made aware that they could sign post queries to the webpage. All the feedback has been very positive and in support of the steps taken. A panel selected our preferred agent from the final tenders received.
