Decision:

To agree a Local Lettings Plan to cover first lets and all subsequent lets of Flats 1 and Flat 2, 38 London Road, Cheltenham, GL52 6DY (owned by Cheltenham Borough Council) for an initial 12 month period (until 1st December 2024), to be reviewed by Cheltenham Borough Council (CBC) and Cheltenham Borough Homes (CBH) officers in August 2024.

Reasons for the decision:

This decision provides Cheltenham Borough Council with the authority to introduce, monitor and review a Local Lettings Plan covering the two social rented properties (Flats 1 & 2) at 38 London Road, Cheltenham, GL52 6DY. This Local Lettings Plan will help to support community wellbeing and community cohesion in an area that has seen long-standing anti-social behaviour and nuisance. By seeking approval for this decision, the Council will be meeting a key priority of our adopted 2023-2028 Housing, Homelessness and Rough Sleeping Strategy, namely ‘investing in our communities to make them safer, stronger and healthier’. For the sake of clarity, this Local Lettings Plan will not apply to the two leasehold properties in this block of flats.
Please note this Local Lettings Plan will be reviewed by key officers from Cheltenham Borough Council and Cheltenham Borough Homes (CBH) in August 2024 following Officer sign-off to determine whether an extension to or amendment of the Local Lettings Plan is appropriate.
If, for any reason, the Local Lettings Plan is not functioning as intended, the Council will have the ability to review the Local Lettings Plan, in consultation with CBH Officers, within 12 months of the approved officer decision date. This Local Lettings Plan will automatically expire on 1st December 2024 in the event that CBH or Cheltenham Borough Council do not seek a review of this Local Lettings Plan during August 2024.

Alternative options considered:

An alternative option considered was not agreeing or implementing a Local Lettings Plan. However, owing to the importance of creating sustainable, resilient and harmonious communities, especially in the context of the long-term, sustained anti-social behaviour and nuisance experienced by residents in the vicinity of these properties, this option has been rejected. Additionally, the Council recognises the potential for reputational damage and legal action against CBH or the Council if tenants (or leaseholders) continue to experience any form of anti-social behaviour arising from Flats 1 and 2, 38 London Road, Cheltenham, GL52 6DY. In this specific context, officers considered the introduction of a Local Lettings Plan in this location to be an appropriate and proportionate course of action.
