Decision:
To appoint CPD Daniell to provide Compulsory Purchase and Compensation Advice in respect of Barn Farm and the acquisition of part for highways works relating to Junction 10 of the M5. Fees based on an hourly rate plus VAT and disbursements, to be reimbursed by Gloucestershire County Council as the Acquiring Authority (hourly rate agreed with the County’s Advisors).
Reasons for the decision:
Gloucestershire County Council, as Highways Authority, is seeking to make improvements to Junction 10 of the M5 to convert it into an all-movements. In order to deliver the works, it needs to acquire land around the existing junction, which includes land in the ownership of the Borough Council.
CPD Daniell is a firm of Chartered Surveyors which specialises in rural and agricultural property and has the necessary experience and expertise of dealing with CPO matters. Further, they have historically advised the council on the existing statutory agricultural tenancy, know the site and have historically dealt with the farm tenant. They are, therefore, best placed to advise the council in this matter and co-ordinate the necessary changes to the existing agricultural lease.
Proper and reasonable fees and costs incurred by the council will be reimbursed by the Acquiring Authority as part of the eventual award of compensation, along with the value of land taken and any impact on the retained land, i.e. injurious affection.
