Reasons for the decision:
The proposed project by Netomnia Ltd will improve the digital experience for the residents of Cheltenham, but in order to do so fibre cables will need to be laid over the Council’s land. One or more wayleaves would be the appropriate means of recording this.
Netomnia Ltd will be meeting the Council’s professional costs. Telemaster Ltd (who are specialists in the field) will be advising the Council on the level of compensation payable by Netomnia Ltd.
Birketts LLP are lawyers experienced in the specialist area of telecommunications.
Alternative options considered:
We could choose to resource in-house but neither Property Services or One Legal currently have the capacity or specialism in this field.
Other reasons / organisations consulted
The Cabinet Member for Finance and Assets has been briefed, in addition to One Legal and Property Services. The result of consultation was to proceed with the grant of wayleaves.
