To accept the offer negotiated with the Contractor relating to technical

assessments as set out in the attached report.

A full review of the risks and benefits to the council in accepting the offer.

This led to further negotiation with the contractor’s legal team and

understanding the financial circumstances of the Contractor.

The project team concluded it is the best outcome for the Council to accept

the current offer as outlined within the attached report.

1. To reject the offer as negotiated – this could risk additional costs to

the council and potentially court proceedings, which on balance may

not result in an improved position.

2. To seek to counter the offer that has already been subject to

negotiation and increased offer – discounted for reasons as above.
