Decision:

1.    To agree to the grant of one or more wayleaves in favour of CityFibre Holdings Ltd (or its nominees) over such of the Council’s land as CityFibre may require in order to lay fibre infrastructure

 

2.    To instruct Telemaster Limited to act on behalf of the Council to negotiate terms with CityFibre Holdings Ltd

 

3.    To instruct Birketts LLP to act as the Council’s legal advisers in connection with the grant of the wayleave(s)

Reasons for the decision:

The proposed project by CityFibre will improve the digital experience for the residents of Cheltenham, but in order to do so fibre cables will need to be laid over the Council’s land. One or more wayleaves would be the appropriate means of recording this.

 

It is understood that CityFibre will be meeting the Council’s professional costs. Telemaster Ltd (who are specialists in the field) will be advising the Council on the level of compensation payable by CityFibre.
