Decision:

To join the newly formed Gloucestershire Resources and Waste Partnership, a non statutory partnership without delegated functions, which  replaces the Gloucestershire Joint Waste Committee

Reasons for the decision:

On 28 November 2018, the Cabinet approved Cheltenham Borough Council’s withdrawal from the Gloucestershire Joint Waste Committee (GJWC), by serving the requisite notice or by negotiated early termination and delegated authority to the MD – Place and Growth, in consultation with the Cabinet Member - Clean and Green Environment and Borough Solicitor, to take all necessary steps and enter into such agreements as appropriate to effect this withdrawal, including seeking observer status for Cheltenham Borough Council at Joint Waste Committee meetings in the same way as Stroud District Council and Gloucester City Council.

 

On 6th December 2018 Cheltenham Borough Council sent notice of its intention to leave the GJWC which triggered the termination provisions within the Inter Authority Agreement (IAA) that governed the committee.

The IAA required the GJWC to be dissolved in 12 months unless two or more of the remaining partners serve a Continuance Notice on all of the other partners no later than 3 months before the Dissolution Date.  A Continuance Notice was not served by the deadline of 13th September 2019), meaning that the GJWC ended on 13th December 2019.

 

Following the June 2019 meeting of the GJWC, the Gloucestershire County Council Senior Managers Group worked with non-voting partner councils to develop a proposal for the future role and structure of a Gloucestershire wide Resources and Waste Partnership without delegated functions and statutory responsibilities, including terms of reference.

 

The new Gloucestershire Resources and Waste Partnership met for the first time on 1st October 2020 and Cheltenham Borough Council is required to formally record its membership of the new partnership and acceptance of the terms of reference attached.

Alternative options considered:

There are benefits to continuing to work in partnership with other local authorities in Gloucestershire and it is therefore considered less helpfulmp for the Council to carry out its waste and environmental functions in isolation.

 

If the Council declined membership of the Group it would also have less opportunity to have input into the discussion of waste and environmental  strategic issues relating to the Council and the county as a whole.
