Decision:

 

That the council does not trigger the 5 year break clause as set out in the existing 10 year shared service agreement for the provision of legal services by One Legal.

 

Reasons for the decision:

On 1st April 2015 the council (together with Tewkesbury Borough Council and Gloucester City Council) entered into a 10 year shared service arrangement for the provision of legal services by One Legal. The agreement gives the partner councils an opportunity to terminate the arrangement in year 5 by giving 12 months’ notice (the break clause).

 

The One Legal Joint Management and Liaison Group (JMLG) undertook a service review to consider whether notice should be given to terminate the existing agreement by exercising the break clause. A copy of their report is appended to this decision.

 

JMLG concluded that they had not seen or heard anything to suggest that there was either a need or a wish to terminate the existing arrangement and that the service provided by One Legal was considered to be good to excellent.

 

JMLG’s recommendation to the partner councils was to continue with the agreement for the full term.

To terminate the arrangement in year 5 by serving 12 months’ notice.
