Decision:

To accept the novation to the Council of Wilmott Dixon’s contract with FacultatieveTechnologies Limited (FT) for maintenance of the cremators at the new crematorium at Bouncers Lane, Cheltenham

Reasons for the decision:

Willmott Dixon, as lead contractor for the construction of the new crematorium, has entered into a contract with FT for the installation and maintenance of new cremators. The contract was procured within the terms of the Scape Framework Agreement.

           

At the point at which construction is complete and the cremators enter operation the Council needs to be able to ensure they are maintained and the maintenance contract must therefore be novated to it.

 

The costs of the maintenance contract are included within the Council’s budget.

Alternative options considered:

Doing nothing – i.e. allowing the maintenance contract to remain between Willmott Dixon and FT - would be wholly inappropriate and impractical.

Other reasons / organisations consulted

Consultation has been undertaken with the Crematorium Development Programme Board including the Cabinet Member for Clean and Green Environment and the Director of Environment (the programme’s Programme Senior Responsible Officer).

 

Consultation has also taken place with Scape.

 

Advice has been given by One Legal.

 

Programme Board supports the acceptance of the novation.

 

Scape has confirmed that the procurement of cremator maintenance and its novation to the Council are permitted under the framework agreement.
