To appoint Willans LLP to provide legal services for Kidnappers Lane development

Decision Maker: Director of Finance and Assets and Deputy Section 151 Officer - Gemma Bell

Decision status: Recommendations Approved

Is Key decision?: No

Is subject to call in?: No

Decision:

To approve the appointment of Willans LLP solicitors to provide legal services for the proposed development at Kidnappers Lane, Leckhampton, Cheltenham (S106 developer led design and build package deal) to provide 9 net zero carbon homes comprising 7 x social rent homes and 2 x shared ownership homes. The scope of services will include legal advice with respect to the land and golden brick agreement, JCT Design and Build contract clause amendments, review of the S106 Agreement and Deed of Variation if applicable, preparation of shared ownership leases and ongoing plot sales, plus any other issue that arises where advice and input is required.

Reasons for the decision:

One Legal do not currently have capacity to provide legal services for this project and a decision has been made to appoint an external solicitor to provide legal advice as required to facilitate this development and deal with subsequent shared ownership disposals.

Three companies were approached to submit a fee quote and the one supplied by Willans represents the MEAT return.

Alternative options considered:

Award the contract to another legal firm who submitted a fee quote – rejected on the basis that Willans fee quote was the most comprehensive submitted and represents the MEAT return.

Other reasons / organisations consulted

The proposal for CBC to secure this site is supported on the basis that it will provide 9 net zero carbon homes for social rent and shared ownership therefore meeting local housing need in an area of Leckhampton and support the Council’s carbon ambitions.
