To approve the appointment of Anthony Collins LLP solicitors to provide legal services for the proposed development at Shurdington Road, Leckhampton, Cheltenham (S106 developer led, off the shelf deal) to provide 5 homes comprising 4 x affordable rent homes and 1 x shared ownership home.  The scope of services will include legal advice with respect to the purchase contract, transfer agreement, review of the S106 Agreement and Deed of Variation if applicable, preparation of a shared ownership lease and ongoing plot sale, plus any other issue that arises where advice and input ins required.

Reasons for the decision:

One Legal do not currently have capacity to provide legal services for this project and decision was made to appoint an external solicitor to provide legal advice as required to facilitate this development and deal with a subsequent shared ownership disposal.  Three companies were approached to submit a fee quote and the one supplied by Anthony Collins represents the MEAT return.

Alternative options considered:

Not to award the contract to Anthony Collins who provided the most comprehensive and financially viable fee quote.

Other reasons / organisations consulted

The proposal for CBC to secure this site is supported on the basis that it will provide 5 homes for affordable rent and shared ownership therefore meeting local housing need in an area of Leckhampton whereby there is limited affordable housing stock.  

Consultees

The proposed development site at Shurdington Road has been discussed with CBC/CBH officers (via SHDG) and with the Cabinet Member for Housing who are supportive of the proposals.
